General Terms and Conditions (AGB)

Albtal Event & Camping GmbH
Version 1.0 – Last updated: 22 October 2026

1. Provider and scope

1.1 Your contracting party is Albtal Event & Camping GmbH, Schwimmbadstraße 29, 76332 Bad Herrenalb, represented by its managing director Patrick Kunzer, registered in the Commercial Register of Stuttgart Local Court under HRB 806959. Contact: info@albtal-arena.de.

1.2 These General Terms and Conditions apply, insofar as they have been validly agreed, to the following services booked individually or not classified as a package travel arrangement: leisure and activity programmes without combined tourist accommodation, in particular Black Forest Games and Winter Games; short tourist stays in cabins; short-term camping stays; catering services and separately booked celebrations or events at the Albtal-Stadl.

1.3 These terms do not cover package travel contracts within the meaning of sections 651a et seq. of the German Civil Code (BGB), in particular combinations of overnight accommodation and a separate, substantial activity programme, insofar as these legally constitute package travel. Separate travel terms, travel information and the required statutory documentation will be provided before binding bookings are made available. Enquiries about planned school trips and comparable programme packages can currently be made only on a non-binding basis; they create neither a binding reservation nor an entitlement to conclude a contract.

1.4 These terms also do not cover seasonal or permanent camping, long-term rental agreements, the purchase or sale of caravans and similar items, or contracts with other legally independent organisers. Separate agreements apply to these matters.

1.5 Individual agreements and mandatory consumer or travel rights take precedence over these terms.

2. Enquiries, offers and conclusion of contracts

2.1 An enquiry made through the website, by email, by telephone or in person is initially non-binding. General descriptions of products on the website do not constitute a binding offer unless expressly stated otherwise in an exceptional case.

2.2 A contract is concluded when we confirm a specific booking or when an offer and its acceptance otherwise form a legally valid agreement. For spontaneous services on site, the contract may be concluded directly on site.

2.3 The individually agreed offer and our booking confirmation determine the content, scope, date, number of participants, price and, where applicable, minimum group size. Changes become binding only when both contracting parties agree to them.

2.4 For group bookings, it must be clear whether a person is acting in their own name or validly on behalf of a school, association, business or other organisation. Merely naming a teacher or contact person does not make that person personally liable for payment.

3. Services and prices

3.1 We provide the services described in the relevant offer or booking confirmation. Additional services, exclusive use, special catering and third-party services are owed only insofar as they have been expressly agreed.

3.2 For consumers, we state the agreed total prices including statutory VAT and compulsory price components. Individually added services are listed separately before booking.

3.3 Exclusive use of rooms or facilities, special time slots or a particular minimum level of equipment apply only if expressly agreed.

3.4 Safety instructions communicated in advance, as well as house and site rules, must be observed during the stay or event insofar as they have been validly agreed or are necessary to prevent specific dangers.

4. Payment and due dates

4.1 The agreed payment is generally due before the event begins for day programmes, and on arrival for individual tourist overnight stays and camping stays, unless otherwise agreed in the individual offer or at the time of booking. Payment for catering services is generally made after the service, unless another valid agreement has been reached.

4.2 For exclusive celebrations and separately priced group events, due dates and any agreed advance payments are expressly set out in the offer or booking confirmation.

4.3 The payment methods offered on site may be used there. Acceptance of a particular type of card is owed only if confirmed before booking.

4.4 Statutory rights in the event of late payment and statutory rights of retention and set-off remain unaffected.

5. Groups, participant numbers and minors

5.1 For group services, please inform us of the binding number of participants by the date stated in the offer. If no date has been agreed, an update should be provided no later than three days before day programmes and seven days before group menus. This notification period alone does not create an additional cancellation charge.

5.2 If participant numbers decrease or increase, payment is determined by the agreed pricing structure and the provisions of section 9. An expressly agreed fixed price or minimum spend is not automatically changed merely because participant numbers decrease; statutory rights and expressly agreed free partial cancellations remain unaffected. Additional people may participate only with our approval and subject to available capacity.

5.3 For school and youth groups, the sending organisation and its appointed accompanying adults remain responsible for general supervision unless specific supervision services have been expressly agreed. Our staff and guides are responsible for the safe conduct of the activities they lead within the scope of statutory duties. Statutory duties of supervision and duties to maintain safety are not excluded.

5.4 Safety-related support needs should be communicated in good time and only to the extent necessary. Data protection requirements remain unaffected.

6. Safety rules for activity programmes

6.1 Participants must observe the participation requirements stated in the service description for the booked programme and follow the safety instructions of guides and staff.

6.2 If specific circumstances create a significant danger to a participant or other people, we may prohibit, interrupt or stop individual activities. In cases of serious danger, immediate exclusion is possible; otherwise, we give an opportunity to change the behaviour where possible.

6.3 Whether payment remains due for a service that is not used or is stopped is determined by statutory provisions and the circumstances of the individual case.

6.4 Accidents, injuries and damage should be reported to staff immediately for safety reasons.

7. Cabins, camping and stays

7.1 Accommodation or a pitch is provided for the agreed period and purpose. Arrival and departure times are stated in the booking confirmation or in the site conditions communicated before booking.

7.2 For the cabin overnight stays offered, we provide the agreed sleeping places with mattresses and toppers. Unless otherwise agreed in the offer, guests must bring a bed cover, sleeping bag and their own pillow.

7.3 Accommodation, sanitary facilities, pitches and other facilities must be treated with care. Fire protection and safety rules must be observed. Open fires are permitted only in designated areas and in accordance with applicable requirements.

7.4 Additional people, animals or additional vehicles may be accommodated only to the extent agreed in the contract or permitted by our site rules communicated in advance. Restrictions are communicated before the contract is concluded.

7.5 Statutory rules apply to damage caused through fault. Normal wear and tear resulting from use in accordance with the contract does not give rise to a claim for damages.

8. Catering and Albtal-Stadl

8.1 For food, drinks, buffets, menus and exclusive use of rooms or events, the services, prices, time slots, participant numbers and any minimum spend agreed in writing are decisive.

8.2 Special dietary requirements and allergies should be communicated before the event and expressly confirmed if they are to be taken into account as a binding requirement. Statutory duties to provide allergen information remain unaffected.

8.3 Food and drinks brought in, decorations, music and external service providers must be agreed in advance insofar as they affect safety, agreed exclusive services or the business's legal obligations.

8.4 Simple table reservations without a separately agreed reservation fee or compulsory minimum spend may be cancelled free of charge. Section 9 applies to exclusive events.

9. Cancellations and changes for services that are not package travel

9.1 General. You may notify us of a cancellation using the contact methods communicated when booking; we recommend emailing info@albtal-arena.de. The time we receive the cancellation determines whether the deadline has been met. The event or arrival day is not counted as a full preceding day. Statutory rights to terminate for extraordinary reasons remain unaffected.

9.2 Free cancellation for direct bookings. Unless a more favourable individual arrangement has been validly agreed when booking, we grant the following free cancellation options for our direct bookings:

ServiceFree cancellation
Individual day programmes and games without overnight accommodationUp to and including 21 calendar days before the start
Individual tourist cabin and short-term camping bookingsUp to and including 14 calendar days before arrival
Exclusive Stadl celebrations and separately booked exclusive eventsUp to and including 60 calendar days before the start
Simple table reservation without a separate feeAt any time

9.3 Later cancellation. If cancellation takes place after the applicable free cancellation period, any remaining entitlement to payment or compensation is determined by the statutory provisions for the relevant type of contract and the valid individual agreement. We take legally required deductions into account, in particular expenses actually saved and benefits from alternative use of the service. On request, we explain the calculation in a comprehensible manner. These terms do not set an automatic flat-rate percentage.

9.4 Partial cancellation. If individual participants or separable services are cancelled, the agreed prices, the free cancellation periods in section 9.2 and otherwise the principles in section 9.3 apply insofar as the service can reasonably be invoiced separately. Separately agreed fixed prices and minimum charges must be taken into account to the extent legally permitted.

9.5 Changes to bookings. We assess requests to change bookings subject to availability. A new booking, postponement or adjustment becomes binding only through express agreement. Any additional costs are communicated before the change becomes binding.

9.6 Refunds. Where a right to a refund arises following a cancellation or change of service, we refund payments already received in accordance with applicable statutory rules.

10. Weather, force majeure and disruption of services

10.1 Programmes may take place in normal rain or changeable weather provided they can be conducted safely and in accordance with the contract.

10.2 In specific dangerous situations, in particular thunderstorms, storms or fire risk, individual activities may be adjusted, interrupted or cancelled for safety reasons. Material changes to services are made only with due regard to the customer's contractual and statutory rights.

10.3 If an agreed service cannot be provided, statutory rights to repayment, a price reduction, withdrawal from the contract or damages apply. A replacement date or voucher is agreed only by mutual consent and does not replace mandatory statutory claims.

11. Liability

11.1 Statutory liability rules apply without restriction in cases of intent or gross negligence and in cases of damage arising from injury to life, body or health.

11.2 For other damage caused by slight negligence, we are liable for foreseeable damage typical of the contract if an essential contractual obligation has been breached. Otherwise, statutory limitations and exclusions of liability apply insofar as permitted.

11.3 Mandatory liability provisions, for example those concerning property brought onto the premises, remain unaffected. Risks arising from our own duties to maintain safety are not transferred to participants through a blanket provision.

12. Value vouchers

12.1 Value vouchers purchased for payment are subject to the redemption conditions stated on the voucher and otherwise to statutory provisions, in particular those concerning limitation periods.

12.2 Bookings for services on specific dates using vouchers are subject to availability. An entitlement to payment in cash exists only insofar as provided by law.

12.3 Different conditions communicated before issue may apply to separately identified promotional vouchers issued free of charge.

13. Data protection and recordings

13.1 We process personal data in accordance with applicable data protection provisions. Details are set out in our separate privacy policy.

13.2 These terms do not contain blanket consent to the publication of photographs or videos of participants, particularly minors. Required consents and other legal bases are dealt with separately.

14. Statutory right of withdrawal

For contracts concerning leisure services on specified dates, tourist accommodation or catering services on specified dates, there is generally no statutory right of withdrawal under section 312g(2), no. 9 BGB. The requirements must be assessed for the specific contract. Other statutory rights to withdraw from or terminate a contract and our voluntary cancellation options under section 9 remain in place.

15. Consumer dispute resolution

We are not willing to participate in dispute resolution proceedings before a consumer arbitration body unless there is a statutory obligation to do so.

16. Applicable law and final provisions

16.1 German law applies. Mandatory consumer protection provisions remain unaffected.

16.2 A special place of jurisdiction applies only insofar as it can be validly agreed by law; statutory rules on jurisdiction apply to consumers.

16.3 If individual provisions of these terms are invalid or have not been incorporated into the contract, statutory provisions apply to the contract in that respect. The other valid provisions remain in place.

16.4 Each contract is governed by the version of these terms validly incorporated into it when the contract is concluded. Later website changes do not automatically apply to existing contracts.
